Right to be Forgotten

The right to be forgotten applies to the taking out of mortgage loans and consumer credit, as well as to the subscription of mandatory or optional insurance linked to those loans, and to credit agreements for commercial or professional purposes when entered into by an individual, even where acting within the scope of their business or professional activity. It also applies to insurance contracts associated with those credit agreements.

 

Frequently Asked Questions

It is the right granted to individuals who have overcome or mitigated situations of increased health risk or disability (including, namely, cancer, HIV, diabetes and hepatitis C), to non‑discrimination when applying for mortgage loans, consumer credit, or credit for commercial or professional purposes, as well as associated mandatory or optional insurance.

These individuals must not be subject to discrimination (for example, being subject to more complex procedures) during the negotiation, conclusion and duration of such contracts.

This right ensures that such individuals cannot be subject to increased insurance premiums or exclusions of cover. Furthermore, no health-related information regarding the condition that led to the increased health risk or disability may be collected or processed by the Bank or insurers during the pre‑contractual stage.

Where the insured person has overcome or mitigated a situation of increased health risk or disability, and the time limits outlined below have elapsed, the policyholder or insured person may answer “no” to questions raised by the insurer (including via the Bank acting as insurance intermediary), in the initial risk declaration relating to life insurance associated with a mortgage or personal loan.

Where applicable, the policyholder or insured person may inform the insurer (even via the Bank as intermediary), during the term of the insurance contract, that the insured person has overcome or mitigated the increased health risk.

The following uninterrupted periods must have elapsed:

a) Ten (10) years after the end of the therapeutic protocol, in cases where the increased health risk or disability has been overcome;

b) Five (5) years after the end of the therapeutic protocol, where the condition was overcome before the age of 21;

c) Two (2) years of continuous and effective therapeutic protocol, in cases where the increased health risk or disability has been mitigated.

No health information relating to increased health risk or disability may be collected by the Bank or insurers at the pre‑contractual stage.

These are individuals who have demonstrably been in a situation of increased health risk (i.e. having suffered from a condition causing long‑term or evolving functional or physical impairment, potentially incapacitating and affecting quality of life or leading to early invalidity or reduced life expectancy), but who are no longer in that situation following a therapeutic protocol that has effectively and durably limited its effects.

These are individuals who have demonstrably had a disability equal to or greater than 60% and who have recovered their psychological, intellectual, physiological or anatomical functions, reducing their level of incapacity below that threshold.

These are individuals undergoing treatments that demonstrably and significantly reduce, in a lasting manner, the effects of their increased health risk or disability.

Law No. 75/2021 of 18 November, as amended, establishes the right to be forgotten for individuals who have overcome or mitigated situations of increased health risk or disability, improving access to credit and insurance contracts. This is further regulated by Decree‑Law No. 79/2026 of 17 March.

Also applicable is Regulatory Standard No. 12/2024‑R of the Insurance and Pension Funds Supervisory Authority, concerning the right to be forgotten and the prohibition of discriminatory practices.

The reference grid establishes more favourable terms and time limits (than those indicated in the question “What are the time limits to benefit from the right to be forgotten?”) applicable to specific medical conditions. It sets out the timeframes after which individuals who have overcome or mitigated situations of increased health risk or disability may benefit from the right to be forgotten when applying for mortgage loans, consumer credit, or credit for commercial or professional purposes (even when acting in a professional capacity), as well as when taking out mandatory or optional insurance linked to those credit agreements.

If a specific condition is not included in the reference grid, the general time limits referred to in the aforementioned question apply.

This reference grid is updated every two years, following consultation with the Directorate‑General of Health and input from the Medical Association, and is published on the SNS24 website.
